Had accident which was my fault in Nov 08, hit a van in rear that stopped suddenly going through a roundabout (less than 5mph) and his trailer hitch ball went into my radiator and damaged the hood, grill and radiator. Car was 1996 Honda in very reasonable condition, MOT'd and all in good service despite its 125,000 mileage, new tyres, exhaust, battery, and clean throughout. Had fully comprehensive insurance with 50 deductable, loaner car and legal support so paid to be protected. When car was collected from accident, collecting garage said at that time that due to the mileage my car would not be repaired. However it took 5 to 6 weeks for the insurance examiner to determine that my car was beyond repair, so I did without a car all that time. Despite repeated phone calls to them, they never called me back as their examiner was on holiday. Then when we finally agree that a price of 500 for my car in January 08 and that took some haggling, the cheque never and so I started chasing them down in early February. I am then informed that I did not disclose a speeding violation on my application and they would have to listen to the tapes of my applying to verify this. Again this took several weeks, and I again had to pursue them for an answer to which they then said I had applied on the internet so no record of a phone conversation. The internet application was misleading, asking for what I believed was 3 years worth of offenses. I've only ever had 2 speeding offenses in my entire life - both speed cameras, just over the limit. The first was at 6 a.m. and I passed a bus pulling over to stop and as I passed it got flashed. The second on the day I found my dad had days to live and I was rushing to catch a flight, and as in both instances was doing 42 mph in a 30 mph zone for a very short period. Nonetheless, I was speeding and paid my fines. I wrote to the insurance company and apologised for not telling them of the other speeding ticket from 4 years and 9 months earlier as I forgot about it. But I admitted it, and apologised in writing. Then then came back to me saying that there would be additional premium to pay before I would get paid for my car. Well, its October 08, and I finally got a letter from the insurers saying they are not paying me as I failed to pay the additional premium requested and they were not going to renew my policy. I have never been asked even after repeated letters to them how much the additional premium was, and what I should do. No replies. I have asked for my car back which they agreed to pay for, and now they state there is nothing they can do, and it is their final decision. I went to the financial ombudsman and unbelieveably DID NOT get a reply from them. I've even spoken to one of their survey staff who tells me that they are incredibly busy and it was probably put aside and not dealt with. I'm at a total loss as to where I stand and how to pursue this without spending more than the accident and car was worth. I've written to their data protection officer and obtained copies of all documentation pertaining to this, so by their records can verify all this information quite clearly. Finally, I maintained my cool with them at all times. Never once did I raise my voice or become unprofessional with them. My questions are: 1. Can I legally request my car back as it has never been paid for? 2. Were they taking money for policy on a car they knew that through mileage alone, they would never pay for loaner car, or to have repaired? 3. This has meant over 30 letters and more phone calls than that to deal with, and rarely do they call you back or reply at all. Can I claim for this time and distress? 4. Am I totally wasting my time? My boyfriend and I were at a stop light the light turned green. We started to go (this area is under contraction so the lanes are all messed up). The car in front of stops then hits their braks so did my boyfriend but it was to late we hit her. The car started to coast back and hit us again. Then we tryed to pull of to the side. We realized that it was a chain reaction. Car #1 was hit by car #2, car #3 hit car # 2 and we hit car #3 in that order. We did not launch all the cars together. Car #2 I'm sure will be going after the older woman in Car #3. The older woman said since it was likely the bumper would just buff out it was ok for my boyfriend to do that for her. But he said he would not touch the front of her car. (After talking to the insurace company they said my boyfriend fixxing it is a bad idea) My boyfriends car is the worse out of all of them it smashed in hood in, and broke the radatior brakets. (His car sat higher then hers and thats why it smashed it) The cop did try to write my boyfriend a ticket but the woman said it wasn't his fault the other cars hit before he hit Car #3. How do you switch from motability to owning a car with the UK's new car insurance policies?

Ok we've got a small problem. At present we get a car from motability, but we want to switch to owning our own car, but we have a major problem with this new all cars must be insured at all times or declared SORN scheme. The problem we have is that our motability car goes back in October. We're in a rural location so we need a car ready for when the switch over happens. At present with the motability insurance their insurance only insures one vehicle, the motability one, and can't have additional vehicles added to it. We've got a few quotes from insurance companies who have told us that when the motability lease expires they will give us the no claim discount based on the motabiity insurance, but they wont give us that discount until the motability car goes back. So what we want to do is get the new car before October, put it on the drive, check everything is ok with it, and then insure it when we start using it on the road when the motability vehicle goes back. Only problem is with this new law we can't do that without declaring the vehicle SORN. Some of the vehicles we've seen come with a few months road tax, so we don't really want to lose that by declaring it SORN, just for a few weeks (or is the tax disc still valid when you remove the SORN on the car?), we also don't want to insure the vehicle before the motability vehicle goes back as we wont get any NCB from the new insurer and that will cost us about an extra 500 in insurance (our current insurance price is about 500-600 but with 0 years no claims it goes up to around 1,000-1,100 - we have 3 years no claims with motability and I've held my driving licence for 6 years). I've read that you don't need this compulsory insurance if the vehicle is in trade, or between registered owners. That is one option, but how long after you buy a vehicle can you keep it in that status, would we be able to keep it like that for a few weeks or is it pretty much instant when we get the car. Obviously I realise I would need some kind of temporary one day insurance to drive the vehicle home after purchase.

I have a 99' silverado LS 5.3 liter truck. It was hit in the parking lot by some fool at work and now all the body panels on the passenger side are dented. I took it to a dealer to get an estimate (since the guy has insurance) they quoted it at 7500 dollars worth of damage. I know that the truck doesn't actually book for much more than that. The truck still drives fine just that it is beat up on one side and the door won't open. I still owe about 3k on the truck. I have yet to get an adjuster to come look at it from state farm. Do you think the truck will be totalled? What are my options and how much will they sell the truck back for if it is a total? If it is a total what value will they go off of and how much should I expect for my truck which was in fair condition? Will the adjuster make a check out to me or will he send it to my bank or both? Any help with this from someone that has had a vehicle totalled by someone else would be greatly appreicated..I really don't know.

Responsible Insurance company won't pay up.?

Long story short. Not my fault. The guy backed into my car. It was parked to sell it. So no insurance policy on it. My BF and I were sitting in the car out of the rain writting out a new for sale sign. The car vibrated like crazy when we drove it to move it back to my place. The guys insurance company didn't even check the alignment or add it to the estimate. The other estimates don't even include the alignment. There could be more damage. I decided to get cash to another car. I have not signed anything yet or recived the check. My car is worth about 2K. It wouldn't be worth it to fix it. Insurance Company $1013.76 Auto Body Shop $1162.00 Ford Dealership $1284.90 Les Schwab Alignment $90.00 361.14 difference. I asked to raise their quote. The Insurance company said no. If I had go to an auto body repair shop of my choice with 1013.76 they would call and ask for them to kick down more money. I am going to notify the insurance company that in writting that I am taking them to small claims court. Any ideas on the letter that I submitt? My BF and I were injured. The medical people are refusing to bill the insurance company responsible. They wanted me to pay up front and get rembursed later or have some other insurance cover it. I didn't want to wait. I used my work health insurance. So they are getting the bill. Any way I can get the Car insurance company billed?
